US DOI Criticizes West Flagler’s Petition for Florida Betting Case Rehearing

The petitioner claims the state’s gambling compact with the Seminole Tribe does not comply with the Indian Gaming Regulatory Act.

The US Department of the Interior (DOI) deemed West Flagler’s request for a rehearing en banc in the sports betting case to be “unwarranted” on Thursday. West Flagler’s request for an en banc hearing of its lawsuit in mid-August marks the latest development in the ongoing legal battle. This extremely unusual event is a rehearing of a case before the DC Circuit Court of Appeals.

En banc rehearings are similar to those held before a panel of three judges, except in front of the most active judges. In a 25-page response, the DOI argued against West Flagler’s motion to rehear the Florida sports betting compact.

Florida Betting Case Rehearing

The DOI said that West Flagler’s rehearing arguments were baseless. The organization made the incorrect premise that the agreement legalizes sports betting everywhere. However, this is not the case with the compact. The DOI panel also clarified that West Flagler can still go ahead and sue the state over its gaming laws, notwithstanding its ruling.

Due to the present situation, sports betting in Florida has been suspended, and it is unknown whether or when it will be reinstated. The Seminole Tribe intends to relaunch the betting business under the Hard Rock banner, but the legal barrier must first be overcome.
