Legal Battle Over Florida Sports Betting Continues

The West Flagler Associates have filed an appeal to the DC Circuit Court of Appeals regarding the Florida sports betting compact with the Seminole Tribe. In 2021, the state legalized sports wagering. Also, it launched sports betting in November 2021 via a new gaming compact with the Seminole Tribe.

A court ruled that the compact violated federal law. As a result, the state halted sports wagering in December 2021. However, a federal appeals court ordered the Department of Interior to accept the state’s agreement with the tribe. Thus, the Seminole Tribe will have exclusive rights for sports wagering in the state.

According to bookie pay per head sources, a fresh study implies the resumption of sports betting may be further delayed due to this ruling and the years-long legal challenge. According to a press release from a firm based in South Florida called Click Orlando, they plan to keep fighting the Seminole Tribe in court over the state’s sports betting agreement. Rehearing of West Flagler Associates’ federal appeal is reportedly in the works.

Rehearing a case is indicated by filing an en banc hearing. These trials differ from the norm in that they are heard by a panel of five judges instead of the more typical three. In June, gaming law expert Daniel Wallach told News 6 that West Flagler Associates could try to appeal to the United States Supreme Court.

According to online gambling reports, considering the circumstances, West Flagler Associates has asked the DC Circuit Court of Appeals to review the case en banc. A review is required, the corporation contended, because the appeal court’s prior decision was “erroneous and would generate uncertainty.” The company’s lawyers recently filed a petition arguing that the Seminole Tribe’s gaming agreement with the state is illegal under the Indian Gaming Regulatory Act (IGRA).
